Is there any way to guarantee that the trademark will be registered?
No one can guarantee this, so do not believe any advertisements. To be registered, the trademark must meet the requirements of Article 1483 of the Russian Civil Code of the Russian Federation. It is possible to assess the mark’s protectability before filing by checking whether the name and/or logo complies with all the requirements. If there are weak points in your mark, it can be modified to improve its protectability.
Can a trademark have multiple owners?
No, although current practices can always change. The only possible way is to apply for a collective mark on behalf of an organization with a common charter, but this a separate procedure with its own nuances.
Will I get a refund if the trademark is refused?
Rospatent does not refund filing and examination fees, because technically the service of accepting and processing the application has been rendered. Accordingly, we do not refund the cost of preparing an application that has already been filed. To avoid a refusal or prepare for the potential obstacles during registration, we always recommend to conduct a search before filing an application. The search allows you to find out whether someone has already registered a similar or identical trademark and whether your mark can be refused by Rospatent based on the provisions of the Russian Civil Code.
What types of trademarks exist?
There are many: verbal, image, combined, three-dimensional, holographic, moving, color, perceived by others feelings (sound, olfactory, etc.)
Who can use the ® and TM symbols?
The ® and TM symbols are warning labels used by trademark owners as an indicator of ownership. The TM symbol has no legal force in Russia (it is used in the United States and Europe to indicate trademarks that are still pending or protected on the basis of use). The ® symbol is mentioned in the Civil Code and the Criminal Code: the owner of a Russian trademark is allowed (but not obliged) to use such symbols as R, ®, “trademark”, or “registered trademark”. If anyone starts using such symbols with trademarks not registered in the Russia, they will be criminally prosecuted.
When can I start using my brand?
Using a brand before obtaining a trademark certificate may be dangerous in terms of violating someone’s rights: you never know if someone has already registered something similar. In this situation, the owner of the earlier trademark owner may accuse you of violating their trademark rights. Therefore, as soon as the creative process of creating a name and logo for your brand has been completed, it is advisable to check if someone has registered an identical or similar name or a logo. For this purpose, we conduct searches covering registered trademarks and pending applications. Is a trademark protected worldwide?
A Russian trademark is protected only in the territory of the Russian Federation. Protection in other countries can be obtained via: – national applications in each of the countries you are interested in; – international registration through to the Madrid system, which allows you to obtain protection in one or multiple countries of your choosing (122 countries are available, which account for over 80% of global trade); – a European trademark that will be protected in the territory of all countries of the European Union (this option is relevant if the EU is your only target market).
Can I claim several variants of the mark in a single application?
Only one variant of the mark is allowed per application, which means that separate applications need to be filed to protect different trademark variants.
What is the lifetime of a trademark?
